Terms and Conditions for Subscribing to Playdayz Playdates
Welcome to Playdayz Playdates. These Terms and Conditions ("Terms") govern your subscription and use of the Playdayz Playdates app (the "App"), operated by Playdayz Playdates Limited ("we," "us," or "our"). By subscribing to and using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not subscribe or use the App.
Subscription Services
1.1. The App facilitates the coordination of childcare and playdates for families.
1.2. Playdayz Playdates serves solely as a scheduling and meeting platform. We do not provide childcare, supervision, or guarantee the quality or reliability of any arrangements made between members. Users are solely responsible for their agreements and arrangements.
1.3. Membership tiers include:
Basic Membership: Access to parent and child meet-ups and playdate childcare coordination within your private community.
Premium Membership: Includes all Basic Membership features plus additional service; school holiday childcare coordination.
1.4. Monthly subscriptions automatically renew unless canceled before the renewal date.
Eligibility
2.1. By subscribing, you confirm that you are at least 18 years old and legally capable of entering into this agreement.
2.2. The App is intended for personal use only and may not be used for commercial or business purposes.
2.3. All members must verify their identity by uploading a valid passport or driving license. Only verified members can continue to access the App’s features.
2.4. We strive to complete identity verification within 24 hours; however, additional time may be required under certain circumstances.
2.5. Failure to complete the verification process may result in restricted access or denial of membership.
Membership and Payments
3.1. Membership fees vary based on the selected plan (Basic or Premium) and are billed on a monthly basis.
3.2. Payment must be made using a valid payment method (e.g., credit card, debit card).
3.3. Subscriptions automatically renew each month unless canceled through your account settings.
3.4. Membership fees are non-refundable except as required by law or expressly stated in these Terms.
Community Guidelines
4.1. Playdayz Playdates fosters a supportive and respectful community. Members must interact with courtesy and professionalism.
4.2. We recognize that unforeseen circumstances may arise. Members are encouraged to approach such interactions with patience and understanding. PlayDayz administrators do not intervene in such scenarios, and members are expected to resolve these matters independently.
4.3. Monetary transactions between members are strictly prohibited.
4.4. Discrimination, harassment, or any form of inappropriate conduct will result in account suspension or termination.
4.5. Members utilizing the school holiday childcare coordination service must adhere to the following guidelines:
The childcare schedule aligns with standard school hours to maintain routine and minimize disruption - unless otherwise arranged by members.
Parents must provide a packed lunch and snacks for their children.
Drop-off and pick-up occur at the host’s residence unless otherwise arranged.
Additional Stipulation (School Holiday Platform): The school holiday platform works by matching up parents in the same area with similar-aged children. As the App grows, there may be occasions when agendas cannot be confirmed if there is insufficient criteria or lack of matching members. Please be aware this scenario can happen from time to time while Playdayz grows in your community.
User Responsibilities
5.1. You are responsible for maintaining the confidentiality of your account credentials.
5.2. Account login details may only be shared with household members who are also registered on the App (e.g., a parent or au pair).
5.3. Users must exchange contact details directly; Playdayz Playdates does not share members' personal information.
5.4. Confidential profile data is visible only to you and is not unnecessarily disclosed to other members.
Identity Verification
6.1. All new members are required to complete identity verification by submitting a valid passport or driving license during the registration process.
6.2. Only members who have successfully completed the identity verification process will be granted continued access to key features, including but not limited to messaging, scheduling, and viewing other members' profiles.
6.3. The purpose of identity verification is to ensure the safety, security, and integrity of the community. Accounts that fail to complete the verification process may be subject to restrictions or denial of access. Playdayz reserves the right, in its sole discretion, to request alternative forms of identification in certain circumstances.
Data Privacy and Security
7.1. Your personal data is handled in accordance with our Privacy Policy.
7.2. Playdayz Playdates does not share users’ contact details. Members must exchange this information directly if they wish to do so.
Additional Stipulation (All Members Section): All members of the community will be listed in the "All Members" section of the App. This feature can be switched off in your settings if you prefer to keep your details private.
Disclaimer of Liability
8.1. No Supervision or Endorsement
Playdayz Playdates is a neutral platform that solely facilitates meetings and scheduling among users. We do not vet, supervise, monitor, verify, or regulate interactions, agreements, or the suitability of any users. We do not endorse or make representations regarding the quality, reliability, safety, or legality of any individual, service, or arrangement made through the platform.
8.2. User Responsibility
Users acknowledge and agree that they are solely responsible for their interactions, decisions, and any arrangements they make through Playdayz Playdates. This includes, but is not limited to, any duty of care, supervision, or agreements entered into with other users. Users assume all risks associated with their participation, including but not limited to personal injury, property damage, or financial loss.
8.3. Limitation of Liability
Playdayz Playdates shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, personal injury, or property damage arising from or related to: (a) any use of the platform; (b) any interactions, disputes, or agreements between users; (c) any reliance on information or communications facilitated through the platform.
8.4. Indemnification
By using Playdayz Playdates, users agree to indemnify Playdayz Playdates from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from or related to their use of the platform, interactions with other users, or violation of these terms.
8.5. No Warranties
The platform is provided "as is," with no warranties of any kind, express or implied, including for uninterrupted or error-free operation.
8.6. Governing Law
This Disclaimer is governed by the laws of the Republic of Ireland, and any disputes shall be subject to the exclusive jurisdiction of the courts in the Republic of Ireland.
Membership Cancellations and Termination
9.1. You may cancel your membership at any time via your account settings. Cancellation will prevent future charges but will not result in a refund for previously paid fees.
9.2. We reserve the right to suspend or terminate memberships for violations of these Terms or Community Guidelines.
Changes to Terms and Membership Fees
10.1. We reserve the right to update these Terms and adjust membership fees at our discretion.
10.2. Members will be notified in advance of any changes. Continued use of the App following such updates constitutes acceptance of the revised Terms.
